    We endeavour to negotiate and resolve all matters in an amicable, timely and cost-effective manner, whether the matters are simple or complex.

    If an amicable resolution cannot be negotiated and Court proceedings become necessary, we can assist you by representing you in the proceedings to seek your desired outcome at trial.

    Wills & Estate Planning

    We are experienced in providing advice on, and preparing, the following:

    • Enduring Powers of Guardianship

    • Testamentary Trusts
  • If you have not yet made a Will, it is recommended that you should do so without delay. By making a Will, you can ensure your wishes are put into effect and that provision is made for those who are closest to you. A death in the family is a very difficult time which can be made more distressing if a person fails to leave a valid Will.

    If you do not have a valid Will, on your death your assets are distributed between your various family members in accordance with formulas set out in the Administration Act.

    If you already have a Will, you should review it regularly to ensure that it continues to accord with your wishes and that changes to your personal circumstances, such as marriage and divorce, have not caused your Will to become void.

    As part of our Estate Planning process, we can also advise you on, and prepare, Enduring Powers of Attorney, Enduring Powers of Guardianship, Advance Health Directives and Testamentary Trusts.

    Criminal & Traffic Matters

    If you are accused of, or charged with, a criminal or traffic offence, we can provide advice and representation in the following areas:

  • If you have been accused of committing a criminal or traffic offence, we can advise you of your rights even if you have not yet been charged by the Police.

    We can also advise and represent you in Court once charges have been laid. In certain circumstances, we can negotiate with the Police or the Director of Public Prosecutions in an effort to seek the withdrawal of the charges or possibly the substitution of less serious charges.

  • We can assist you by preparing and lodging various documentation at Landgate, including Caveats, Survivorship and Transmission Applications, Transfers and Leases as well as advise you in relation to stamp duty issues which might impact on those transactions.

    Debt Collection

    We can assist you with:

    • Recovering debts through the commencement of legal proceedings
    • Enforcement proceedings (including representation in Court at Means Enquiries and preparing documents seeking Property Seizure and Sale Orders)

  • Restraining Orders

    We can assist you in relation to:

    • Misconduct Restraining Order Applications
    • Violence Restraining Order Applications
    • Negotiating a resolution of restraining order proceedings by way of undertakings
    • Appearing on your behalf at hearings
  • Restraining Order proceedings are often commenced during highly volatile or turbulent periods between the parties.

    We can prepare Misconduct or Violence Restraining Order applications and appear on your behalf throughout the proceedings. If the matter proceeds to a hearing, we can represent you in Court.

    In some circumstances, it may be appropriate for the parties to consider resolving the proceedings by way of undertakings being given to the Court.

    Personal Injury Claims

    • Motor Vehicle Accident claims
  • If you are the victim of crime and you suffer an injury or loss as a result, we can assist you by preparing an application for Criminal Injuries Compensation and gathering all required evidence in support of your claim.

    We can also advise and represent you in Motor Vehicle Accident claims made with the Insurance Commission of WA in the event you have been injured in a motor vehicle accident.

    Litigation and Dispute Resolution

    We can advise and represent you in:

    • Civil Cases before the Magistrates, District and Supreme Courts
    • Mediation Conferences
    • Informal Conferences
  • If you are involved in, or seek to commence, legal proceedings before the Magistrates, District or Supreme Courts, we can advise and represent you in those cases.

    Given that legal costs in civil proceedings can escalate quickly, where possible we recommend that a Mediation Conference or an Informal Conference be convened between the parties to the proceedings to ascertain whether a negotiated agreement can be reached at an early stage.
